Product Recall

Every year in excess of 29 million Americans are injured as a result of faulty products, of those approximately 20,000 die. A product recall can cover almost any products, from faulty electrical good to cars with faulty engine design. The definition of a defective product is that which causes harm to the consumer even when the consumer is using the product in the prescribed manner. However not all accidents are grounds for a claim under personal injury law.

There are many causes of products that are not fit for sale reaching the stores, the most common being that the product has an inherent design flaw which was not picked up during the design and testing phases. Product recalls are unfortunately usually a reactive measure after a number of people have been injured or hurt using the product in question.

Within the automotive industry crash testing is a major area for concern, most tests are conducted at only 40m/ph whereas most crashes are at a significantly greater speed and thus call into question the reliability of the tests.
