Class Action Lawsuit
A class action lawsuit is one that is taken out by one or more people all of whom have suffered some form of personal injury. The most common form of a class action lawsuit is when a group of people have been affected by the same product due to some inherent design flaw or the product having negative health effects and insufficient warnings. Examples of class action lawsuits would include claims against tobacco companies, manufacturers of product such as asbestos, and claims against car makers if one of their models is considered dangerous.
For a class action lawsuit to be considered it needs to be proven that the claimants all suffered as a result of the same negligence. The class action lawsuit is the ideal form of re-dress for situations where many people have experienced the same negligence but any compensation awarded would be of a smaller amount that in other cases. A class action lawsuit is therefore more effective in bringing a negligent company to book as the sums payable in compensation are usually large.
As well as dangerous products, it is also possible to bring a class action lawsuit for breach of contract – when a company is unable to fulfill its contractual obligations to many of its customers due to its negligence. Securities claims are also a common area of class actions particularly in the situation where a company lies in order to improve its share value and then investors lose money as a result of the truth becoming known.
If you believe that you have a valid claim to be part of a class action lawsuit, contact a specialized class action lawyer as soon as possible in order to ascertain your legal standing and your rights for pursuing this option.
